$2 Million Win
After two years of exercising option payments and extending the closing date, 110 East contrived to terminate a $15 million real estate contract. 110 East sued firm client, Rydan, to recover the $2 million in option payments and the downpayment that had been deposited in escrow. Rydan simultaneously sued for judgment to release and recover the funds in escrow.
With the outbreak of litigation, Rydan came to Slarskey LLC to consolidate its litigation strategy. The firm simultaneously moved to dismiss 110 East’s complaint, while moving for summary judgment in Rydan’s action. The firm prevailed both ways—offensively and defensively—and again on appeal.
