When to Sue and When to Settle: A value-oriented view towards litigation

I recently wrote a brief article with some thoughts about how to evaluate a prospective (or existing) lawsuit, and decide when to sue and when to settle. Litigation should be analyzed like any investment: with a deliberate assessment of the costs and prospective benefits of pursuing a particular course.

 

An experienced litigator brings to this process the ability to identify areas of risk and strength, a conflict-free eye, focused on objective assessment and the client's interests, without the subtle influence associated with pursuing legal strategies that might benefit the lawyers more than the overall risk/reward matrix would suggest is warranted.
